Argus Monitor License Agreement¶

Trial Limited Version¶

The trial limited version of this software may be used for evaluation purposes at the user's own risk for a period of 30 days. At the end of the trial period, the user must either purchase a license to continue using the software, or remove it from own operating system. The trial limited version may be freely distributed, provided the distribution package is not modified. No person or company may charge a fee for the distribution of ArgusMonitor without written permission from the authors.

Licensed Version¶

On payment of the appropriate license fee, the user is granted a non-exclusive license to use Argus Monitor on the number of computers the license was purchased for, regardless if they are used for private or commercial purposes. The number of computers Argus Monitor can be installed on can be increased by paying an additional license fee. The license is valid for all new releases of Argus Monitor released within the 1-year or 3-year period that was purchased, counting from the day of purchase. Once the license period has ended the user will still be able to use all versions of Argus Monitor released previous to the expiration of the license. The registered software may not be leased or transferred to others.

Liability¶

Whilst every care has been taken in the construction and testing of this software, it is supplied subject to the condition that the user undertakes to evaluate the suitability of the control for own purposes. Argotronic eGbR makes no representation of the software's suitability for any purpose, and the user agrees that Argotronic eGbR has no responsibility for any loss or damage occasioned by the use of this software.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE AND DOCUMENTATION ARE PROVIDED "AS IS" AND Argotronic eGbR DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, CONFORMANCE WITH DESCRIPTION, TITLE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Argotronic eGbR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES OR LOST PROFITS WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF Argotronic eGbR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, Argotronic eGbR CUMULATIVE AND ENTIRE LIABILITY TO YOU OR ANY OTHER PARTY FOR ANY LOSS OR DAMAGES RESULTING FROM ANY CLAIMS, DEMANDS OR ACTIONS ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THIS LICENSE.

Prohibited Areas Of Use¶

Argus Monitor IS NOT FAULT-TOLERANT AND IS NOT DESIGNED OR INTENDED FOR USE IN HAZARDOUS ENVIRONMENTS REQUIRING FAIL-SAFE PERFORMANCE, INCLUDING WITHOUT LIMITATION IN THE OPERATION OF LIFE-CRITICAL SYSTEMS, MEDICAL EQUIPMENT, LIFE-SUPPORT MACHINES, SAFETY-CRITICAL SYSTEMS, AUTOMATED TRANSPORTATION SYSTEMS, AUTONOMOUS VEHICLES, AIRCRAFT NAVIGATION OR AIR TRAFFIC CONTROL, NUCLEAR FACILITIES, WEAPONS SYSTEMS OR ANY OTHER APPLICATION IN WHICH THE FAILURE OF THIS APPLICATION COULD LEAD DIRECTLY TO DEATH, PERSONAL INJURY, OR PROPERTY DAMAGE.

Argus Monitor is not intended to be used or incorporated in your application or system without fully testing and validating the readiness of your application or system. You acknowledge that you are ultimately responsible for verifying and validating your application or system, including the appropriate design, process, and safety level of such application or system. You agree to take precautions in using this application, such as not using it where personal injury or property damage may result, and maintaining full backups of storage media.

Miscellaneous¶

Should any term of these terms and conditions be declared void or unenforceable by any court of competent jurisdiction, such declaration shall have no effect on the remaining terms hereof. If you do not agree to these conditions you must not install this software. Place of jurisdiction is Munich, Germany.
